Terms of Service

These Terms of Service ("Terms") govern your access to and use of Atlas, a DM automation platform for Instagram Business creators. By creating an account or using Atlas, you agree to these Terms.

1. Description of Service

Atlas is a software-as-a-service platform that enables Instagram Business creators to automate direct message responses, manage lead conversations, and configure comment-triggered DM flows using AI-generated responses via Meta's Instagram Business API.

2. Eligibility

You must:

• Be at least 18 years old
• Have a valid Instagram Professional (Business or Creator) account
• Use Atlas in compliance with Instagram's Terms of Use and Meta's Platform Policies
• Have the legal authority to bind any business entity on whose behalf you use Atlas

3. Account Responsibilities

You are responsible for:

• Maintaining the security of your Atlas account credentials
• All activity that occurs under your account
• The content of all messages sent through Atlas on your behalf
• Ensuring your use of automated messaging complies with applicable laws and Instagram's policies
• Keeping your Instagram access token valid by reconnecting when it expires

4. Acceptable Use

You agree NOT to use Atlas to:

• Send spam, unsolicited messages, or harassing content
• Violate Meta's Platform Policies or Instagram's Community Guidelines
• Automate messages that are misleading, deceptive, or fraudulent
• Collect or harvest user data beyond what is necessary for your legitimate business purpose
• Circumvent Meta's rate limits or messaging restrictions
• Impersonate other individuals or entities

5. Meta Platform Compliance

Atlas operates under Meta's Instagram Business API. Your use of Atlas is also subject to:

• Meta's Terms of Service
• Meta's Platform Policy
• Instagram's Terms of Use

If Meta restricts, suspends, or terminates access to its API, Atlas may be unable to provide some or all services without liability to you.

6. AI-Generated Content

Atlas uses AI models (including Anthropic Claude and OpenAI) to generate message responses based on your configured scripts and persona. You acknowledge that:

• AI responses are generated based on your configurations and may not always be perfect
• You are solely responsible for reviewing and approving the content your AI persona sends
• Atlas does not guarantee the accuracy, appropriateness, or effectiveness of AI-generated messages

7. Intellectual Property

Atlas and its original content, features, and functionality are owned by us and are protected by intellectual property laws. Your content (scripts, personas, configurations) remains yours.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms, Meta's policies, or applicable law. You may cancel your account at any time by contacting us. Upon termination, your data will be deleted within 30 days.

9. Disclaimer of Warranties

Atlas is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that automated messages will always be delivered due to platform restrictions beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, Atlas shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to lost revenue, lost data, or loss of business opportunities.

11. Changes to Terms

We may update these Terms at any time. Continued use of Atlas after changes are posted constitutes your acceptance of the new Terms.
